Sean “Diddy” Combs is seeking a two-month delay in his upcoming criminal trial, citing new developments that his legal team says prevent them from being ready by the current May 5 start date.

The request, filed Wednesday in a letter to Judge Arun Subramanian and obtained by Billboard, comes as prosecutors recently filed new charges in a superseding indictment. Diddy entered a not guilty plea to those charges earlier this week.

In the letter, attorneys Marc Agnifilo and Teny Geragos argue that the case has shifted significantly in recent days, making a May trial date impractical. They say the extra time would allow them to properly prepare a defense, especially in light of the revised indictment. They also disclosed that Brian Steel, best known for representing Young Thug in his ongoing YSL trial, has officially joined Diddy’s legal team.

“The government created this problem,” the attorneys wrote, “yet they now oppose our reasonable request.” They also note that courts regularly allow delays when prosecutors file superseding indictments, especially when the changes could unfairly disadvantage the defendant.

The tone of the letter echoes Agnifilo’s remarks during Monday’s hearing, where he first floated the idea of a delay. At that time, he asked for a “very short” two-week adjournment. Now, the request has expanded to 60 days. Judge Subramanian, however, appeared reluctant to accommodate any delay. “We are a freight train moving toward trial,” he said in court.

Despite the request, the trial remains set for May 5. Whether Subramanian will formally grant the delay remains to be seen.

Diddy was arrested in September on serious federal charges, including alleged sex trafficking and racketeering. He has denied all allegations and continues to assert his innocence. He’s currently being held at the Metropolitan Detention Center in Brooklyn as he awaits trial.

The inclusion of Brian Steel could signal a more aggressive defense strategy, especially given Steel’s experience navigating complex criminal trials in the public eye. The case against Diddy has drawn intense scrutiny, both for the nature of the charges and the high-profile figure at its center.

As the trial date approaches, Diddy’s legal team continues to push for more time, arguing that justice requires it. For now, the case remains in flux, with the court yet to rule on whether the May 5 start will stand.
