Keefe D‘s legal team is reportedly seeking to have all charges against him dismissed in connection with the fatal 1996 shooting of Tupac Shakur.

On January 6, attorney Carl E.G. Arnold filed a motion urging the court to drop the case, arguing that the nearly 30-year delay before prosecution violated Keefe D’s constitutional rights. Arnold described the delay as “unjustified,” stating it caused “fading memories, the death or disappearance of witnesses, and the loss or destruction of key physical evidence.” He further alleged that authorities are relying on recycled evidence the Las Vegas police possessed as early as 2009, claiming this has irreparably compromised the case and violated his client’s rights.

Furthermore, Arnold argues that the prosecution’s case hinges solely on Keefe D’s unverified claims that key witnesses are either deceased or incarcerated.

He also references a supposed 2008 “proffer agreement” with a federal-Los Angeles task force, suggesting Davis was granted immunity in exchange for details about Tupac Shakur’s murder. The attorney asserted, “The State of Nevada was in possession in 2009 of the facts that led to [Davis’] arrest in 2023.” “Specifically, his alleged statement that he was in the white Cadillac and handed the gun to the back seat passengers, which was utilized to shoot Tupac Shakur.”

Arnold stated that prosecutors “must now honor the initial proffer agreement of 2008 and the LVMPD’s promise not to prosecute Mr. Davis.”

In September 2023, Keefe D was taken into custody for his alleged connection to Tupac Shakur’s 1996 murder, a case partly built on his own admissions in interviews and a memoir. As he awaits trial on March 17, a hearing on January 21 will address his bid to have the charges dismissed.
