JAY-Z Seeks to Overturn Rape Lawsuit, Cites Legal Technicalities

According to reports, JAY-Z has once again moved to have the lawsuit accusing him of assaulting a 13-year-old girl dismissed, this time leaning on procedural grounds.

Last week, the music icon sought to have the case thrown out and pushed for his accuser’s name to be made public—both efforts rejected by the court. Attorney Alex Spiro has filed a motion to dismiss the lawsuit, invoking procedural arguments centered on when the alleged assault occurred. He asserts that the accusation does not meet the criteria of the Violence Protection Act (GMVA) in New York City, as the incident allegedly happened after the law’s implementation.

The legal motions stated, “Plaintiff asserts a violation of the GMV Law for conduct that purportedly occurred in September 2000. But the GMV Law was not enacted until December 19, 2000, three months after the FAC claims the conduct occurred, and cannot apply retroactively to create a cause of action unavailable to Plaintiff at the time in question.” Spiro contends that the woman’s lawsuit lacks merit, asserting that the GMVA statute governs cases strictly within city boundaries. He argues that her claims of being raped at a property fall outside its jurisdiction.

An unnamed woman claims she was sexually assaulted at an afterparty thrown by Diddy, held in a sprawling white mansion with “a gated U-shaped driveway,” about a 20-minute drive from Radio City Music Hall, the venue for that night’s 2000 MTV Music Awards. She alleges that Diddy and JAY-Z raped her in a bedroom after she was drugged. Her lawyer, Tony Buzbee, has not issued a statement regarding the case.

JAY-Z Denounces Allegations as “Idiotic,” Defends Integrity

Since the allegations surfaced earlier this month, JAY-Z has fiercely denied them, labeling the claims as both “heinous” and “idiotic.”

In an unusually candid statement, he also criticized Buzbee, a key figure in a separate ongoing legal conflict. JAY said, “You have made a terrible error in judgment thinking that all ‘celebrities’ are the same.” “I’m not from your moral world. I’m a young man who made it out of the project of Brooklyn. We don’t play these types of games. We have very strict codes and honor.” He continued, “We protect children, you seem to exploit people for personal gain. Only your network of conspiracy theorists, fake physics, will believe the idiotic claims you have levied against me that, if not for the seriousness surrounding harm to kids, would be laughable.”

Earlier this month, Alex Spiro gathered journalists at Roc Nation’s headquarters to present a detailed rebuttal to the accusations facing his client. In his address, Spiro displayed images of JAY-Z at an event distinct from the one his accuser had cited, further asserting that none of Diddy’s properties during the period in question matched the descriptions outlined in the lawsuit.
