Early yesterday, reports circulated that podcast personality Taxstone had been released from jail on $500k bail, following his arrest for his involvement in the Irving Plaza shooting back in May. However, those reports weren’t quite correct, as it turned out that prosecutors told a Manhattan federal court judge that they are convinced it was Tax who fired the fatal shot that night, and that additional charges could be coming.

“The gun here was fired into the chest of the deceased by the defendant,” Manhattan federal prosecutor Haggen Scotten told judge Lewis Kaplan. “We think the evidence of that is actually fairly strong. We have testimony of witnesses. One, if credited, would show that he fired at least the shot that killed McPhatter.”

Tax has not yet pled to the gun charges but his lawyer, Kenneth Montgomery, said his client’s criminal days were behind him, and they should not be trying to use his podcast to paint the picture that he is a gang banger.
